DMCA Policy

SevernLighting, Inc. (“SevernLighting”) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and Title 17, Section 512 of the U.S. Code, SevernLighting will respond promptly to claims of copyright infringement reported to our designated DMCA agent as outlined below.

1. Notification of Claimed Infringement (Notice and Takedown)

If you believe that material available on or through the SevernLighting.com website infringes your copyright, you may submit a written notification containing the following required information:

1. A physical or electronic signature of the copyright owner or an authorized representative.

2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.

3. Identification of the material that is claimed to be infringing, including sufficient information to allow SevernLighting to locate it on our site.

4. Contact information of the complaining party, such as a name, mailing address, telephone number, and email address.

5. A statement of good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement, under penalty of perjury, that the information in the notification is accurate and that the complaining party is authorized to act on behalf of the copyright owner.

Please include the following two statements exactly as written:

“I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.”
“I declare that the information in this notification is accurate and, under penalty of perjury, that I am the owner, or authorized to act on behalf of the owner, of the copyright or exclusive right that is allegedly infringed.”

All properly formatted DMCA notifications should be sent to the Designated Agent listed above. Upon receipt, SevernLighting will review the claim and take appropriate action in accordance with the DMCA, which may include removing or disabling access to the material in question.

3. Counter-Notification Procedure

If you believe that material removed or disabled by mistake or misidentification should not be subject to takedown, you may submit a counter-notification in accordance with Section 512(g) of the DMCA.
This counter-notification must include:

1. Your physical or electronic signature.

2. Identification of the material that has been removed or disabled, and the location where it appeared before removal.

3. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the U.S. federal court for your district (or, if outside the U.S., for any judicial district where SevernLighting may be found).

Upon receiving a valid counter-notice, SevernLighting may restore the material in accordance with the DMCA unless the original complainant seeks a court order.

4. Repeat Infringer Policy

SevernLighting reserves the right, in its sole discretion, to terminate user accounts or access for individuals who are determined to be repeat infringers of copyrighted material.

5. Cooperation with Standard Technological Measures

SevernLighting supports and cooperates with standard technological measures used by copyright owners to identify and protect their copyrighted content.

6. No Liability for Removal of Content

SevernLighting assumes no liability for claims arising from the removal of or disabling access to content following a properly submitted DMCA notice.
