DMCA Policy

The Digital Millennium Copyright Act (DMCA) is a 1998 U.S. copyright law implemented by two 1996 World Intellectual Property Organization (WIPO) treaties. The Act criminalizes the production and distribution of technology, devices, or services designed to circumvent access control measures (commonly known as digital rights management, or DRM) for copyrighted works. The Act also criminalizes circumvention of access controls, regardless of whether it actually constitutes copyright infringement. Furthermore, the DMCA increases penalties for copyright infringement on the internet. The DMCA was passed unanimously by the U.S. Senate on October 12, 1998, and signed into law by President Bill Clinton on October 28. The Act amended Title 17 of the United States Code to expand copyright protection while limiting the liability of online service providers for copyright infringement by their users.

The DMCA's primary innovation in the copyright field is its exemption from direct and indirect liability for internet service providers and other intermediaries. This exemption was adopted by the European Union in the 2000 E-Commerce Directive. The 2001 Information Society Directive implemented the 1996 WIPO Copyright Treaty in the EU.

Severnlighting Digital Millennium Copyright Act (DMCA) Policy Overview

This policy is intended to comply with Title II, Section 512 of the Digital Millennium Copyright Act (DMCA). Severn Lighting respects the legal protections provided by applicable copyright laws.

Pursuant to the DMCA's "Notice and Takedown" procedure, copyright owners may submit a notification of alleged infringement to Severnlighting designated agent. Severnlighting will be exempt from monetary liability if, upon receipt of proper notification, it promptly removes or disables access to the allegedly infringing material.

Furthermore, the Provider assumes no liability for claims brought against any person resulting from the removal of material. Severnlighting.Inc. respects the legal protection provided by applicable copyright laws.

Designated Agent

Any notifications of alleged infringement should be sent to our designated agent. Upon receipt of a notification of claimed infringement, we will follow the procedures outlined in this policy and the DMCA.

Complaints submitted to our designated agent will be forwarded to Severnlighting internal content administrator for the SevernLighting.com website.

Complaint Notification Procedure for Copyright Owners

1. Notifications of alleged copyright infringement sent to the designated agent must include the following:
2. An electronic or physical signature of the copyright owner or the person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
3. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
4. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Severnlighting to locate the material.
5. Information reasonably sufficient to permit Severnlighting to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.

  • A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Failure to include all of the above information may result in delays in processing or DCMA notification.
Include the following two statements in the body of the notification:

  • "I hereby state that I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (e.g., as fair use).
  • "I hereby declare that the information in this notification is accurate and, under penalty of perjury, that I am the owner of the copyright or exclusive right that is allegedly infringed, or am authorized to act on the owner's behalf."

Notice and Takedown Procedures

Severnlighting will comply with applicable copyright laws. However, if Severnlighting receives notification of claimed copyright infringement or otherwise becomes aware of facts and circumstances that clearly indicate infringement, we will act expeditiously to remove or disable access to the material claimed to be infringing or to the subject of infringing activity. If a counter-notice is received by our designated agent, Severnlighting will comply with the relevant provisions of the Digital Millennium Copyright Act (DMCA).

Repeat Infringer Policy

In appropriate circumstances, Severnlighting may, at our sole discretion, terminate the authorization of users of our systems or networks who are repeat infringers.

Cooperation with Standard Technological Measures

Severnlighting policy is to cooperate with and not interfere with standard technological measures used by copyright owners to identify or protect copyrighted works, as we deem appropriate under the circumstances.
